「去年在iTunes上買音樂的人有一億一千萬,而每位客戶的平均年度消費金額略比$30多一點」

看這個數據我們想想,Spotify現在有四千五百萬免費用戶、一千五百萬付費訂戶;而因為Apple看來和唱片公司已經打定主意要殺掉freemium模式了,那麼它究竟能創造多少$10/月的訂戶呢?

另外,關於音樂,我直覺上不看好Google;那是一家技術與商業模式很牛B的公司,但它並不以文化底蘊為立國基礎。

除了iTunes, KKBOX, 以及我們只專注在全球小眾的MUZIK Online,在音樂串流上我看不出來有誰真正賺得到錢。

Spotify這種每年虧上億美金、只是靠拱局滾資本財撐大泡沫的,和Amazon的級數還相差太遠。

(1) 預付儲值,哪來的利息收入。(2) 悠遊卡能收取之清算清分手續費在超商這些零售點已經低到0.5%以下。 (更別提,悠遊卡還身兼交通票證,遊戲業有什麼?! 你要靠哪邊生出來的錢給消費者優惠?!)…

After all ,there are simply too many laws to comply. 從上面幾個簡單的例子讀者可以清楚了解到事實上在企業的商業活動當中,動不動就有可能會違反法律,畢竟,企業必須遵守的法律實在是太多了,多到企業經營者根本無法全盤兼顧,更何況新的法律雖時都在增訂,要不誤觸法網真的很難,更殘酷的一點是,除了台灣的法律企業必須遵守之外,還有國外的法律也不能不管,這裡便要舉一兩個違反國外法律的例子。 案例事實1(違反德國專利法) A公司是專門生產電子產品的企業,為了能順利將其產品推廣到全世界,而計畫參與在德國舉辦之世界知名的消費電子展覽,A公司為了參加此展覽精心籌劃了許久,但是卻萬萬沒有想到,展覽才開始沒多久,就有大批德國檢警出現在展覽攤位前,宣稱A公司所展覽的產品遭到指控有侵害B公司的專利權之情事,而將A公司的相關產品予以全數扣押,使A公司不旦期待已久之展覽付諸流水,商機盡失,大批產品被扣押,可能還要負擔違反該國專利法之相關責任,損失慘重! 案例事實2(違反美國專利法)1 聯華電子股份有限公司(以下簡稱聯電)於2001年向美國國際貿易委員會(International Trade Commission,簡稱ITC)指控矽統科技股份有限公司(以下簡稱矽統)侵害其所擁有之兩項美國專利權,要求美國國際貿易委員會展開調查。聯電聲稱矽統於美國境外製造並進口至美國的晶片包含有聯電所擁有的美國專利技術內容,要求ITC展開調查、依據美國關稅法337條禁止矽統繼續進口及在美國境內銷售該晶片並將侵權之晶片排除於美國境外。 最後委員會認定聯電的專利權係屬有效,而矽統之銷售與進口該晶片是違反美國專利法之規定,發布排除命令,直到2017年以前所有侵權相關之產品都不得輸入美國或是在美國銷售。 矽統於得知裁決結果之後便與聯電協商,由聯電「入股」矽統而董事長則由聯電的執行長來擔任,由此也可得知企業法令遵循之重要性,一不謹慎連經營權都得拱手讓人了! 違法理由分析…
